AgileCraft Privacy Policy

We at AgileCraft LLC ("AgileCraft") know that our users ("you", "your") care about how your personal information is collected and used. This privacy policy (the "Privacy Policy") outlines the information we collect, how we collect it and how we use the personal information you provide when you use and access our Website or access the AgileCraft Products or Services on behalf of our customers.

Information Collection and Use

We collect information about you when you provide it to us, when you use our Services, and when other sources provide it to us, as further described below.  

Website Contact Information: You are free to explore our Websites without providing any Personal Information about yourself. However, when visiting our Websites, we do collect your Personal Information when you request certain information, like information about our products and services, if you request a white paper, or when you register for an event, like a webinar. In addition, we collect certain Host Information and Usage Information. "Host Information" means certain information about your computer, browser, and systems that we collect when you access the Websites or the AgileCraft Services, including your IP address along the network path, operating system type and version, and browser type, client version, the MAC address of your internet connection MAC address, and geographical location. We track IP address to improve our security related to DDOS and similar attacks and for auditing purposes. IP address information is purged within 30 days or less. "Usage Information" means the information we record about your usage of, and interactions with, the Websites or the AgileCraft Services, including actions taken, date and time, frequency, duration, quantity, quality, network connectivity, and performance information related to logins, clicks, and other feature usage information. This Usage Information is anonymized to protect your privacy.

You can unsubscribe from a notification by following the instructions included in the notification.

Account Registration: You must provide basic information including your first name, last name, city and email for account registration ("Required Information"). AgileCraft may use your contact information for application notifications or to send you information about our Products. You can unsubscribe from a notification by following the instructions included in the notification.

Support: You may choose to submit a support ticket regarding a problem you are experiencing with our Products or the AgileCraft Services. We collect your name, email, a description of the problem and other documentation to help you resolve the problem submitted.

Application use: When using the AgileCraft Products and Services, you may choose to provide certain information, including any data, content, code, video, images or other materials of any type that you upload, submit or otherwise transmit (the "Data"). We handle this Data according to the requirements set forth in the relevant agreements with our customers.

Use of Cookies and Other Web Technologies:

Like many providers, we use cookies to collect website usage data and to improve our offerings. A cookie is a small data file that is transferred from our servers to your device when you use and access our Website or when you click on certain HTML-formatted emails. We use "cookies," web beacons, pixel tags, scripts or other similar technologies to help personalize your experiences with AgileCraft. In addition, these technologies permit us to do the following:

  • analyze trends and collect statistics regarding Website usage and the usage of the AgileCraft Services;
  • administer the Websites and/or the AgileCraft Services;
  • tailor information presented to you based on your browsing preferences, such as language and geographical region;
  • track visitors’ and users’ movements around our Website and the AgileCraft Services to better understand features of the Website and/or the AgileCraft Services that are used more frequently than others;
  • gather demographic information about our visitors, users and customers;
  • ensure that users can stay logged into the AgileCraft Services until he/she affirmatively decides to log out; and
  • improve the performance and efficiency of the Websites and the AgileCraft Services.


These technologies store Required Information and Optional Information, and we only use these technologies using transport encryption. We will notify you and gather consent when we utilize cookies in our Website or Products.

Reconfiguring Your Web Browsers to Reject Cookies. You have the ability to accept or decline cookies. Most web browsers are configured to automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. You can refuse cookies by turning them off in your browser. If you have previously visited our Websites, you may also have to delete any existing cookies from your browser. If you’ve set your browser to warn you before accepting cookies, you will receive the warning message with each cookie. You do not need to have cookies turned on to use our Website, but if you re-configure your browser settings to decline cookies so that we cannot collect and record any Required Information, you will not be able to access and use any of the AgileCraft Services. Additionally, you do need to accept cookies to participate in message boards, forums, polling and surveys.

You may also be able to adjust your browsers’ settings to decline cookies or alert you when a website is attempting to place a cookie on your computer. Disabling cookies may prevent you from using some functionality in the Products.

Do-Not-Track

There are different ways you can prevent tracking of your online activity. One of them is setting a preference in your browser that alerts websites you visit that you do not want them to collect certain information about you or the way you interact with that website. This is referred to as a Do-Not-Track ("DNT") signal.

Please note that our Websites may not recognize or take action in response to DNT signals from web browsers. At this time, there is no universally accepted standard for what a company should do when a DNT signal is detected. In the event a final standard is established, we will assess how to appropriately respond to these signals.

Information Sharing

Service Providers: AgileCraft engages service providers to provide services which may require sharing your information. Our third-party service providers provide website and application development, hosting, backup, storage, payment processing, analysis and other services for us, which may require them to access or use information about you. Our providers perform their services in compliance with our privacy policies and other appropriate security measures.

Information Access and Deletion

Accessing and Modifying Your Personal Information: If you are a registered user of the AgileCraft Services, we provide you with tools and account settings to access, correct, delete, or modify the personal information you provided to us and associated with your account.

Portability: You can request a copy of the information you have shared with AgileCraft by sending a message to support@agilecraft.com.

Right to be Forgotten. You can request to have your information redacted from our system by sending a message to support@agilecraft.com. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations.

End of Subscription Term: We remove or delete your data within a reasonable period of time after the termination of your agreement to purchase the AgileCraft Services.

Opting Out and Unsubscribing.

Reviewing, Correcting and Removing Your Personal Information. Upon request AgileCraft will provide you with information about whether we hold any of your Personal Information. If you provide us with your Personal Information, you have the following rights with respect to that information:

  • To review the user information that you have supplied to us;
  • To request that we correct any errors, outdated information, or omissions in user information that you have supplied to us;
  • To request that your user information not be used to contact you;
  • To request that your user information be removed from any solicitation list that we use;
  • To request that your user information not disclosed to a third party;
  • To request that your user information be deleted from our records; and
  • To opt out of being solicited by AgileCraft.


Each promotional email from AgileCraft or from our third-party service providers includes instructions on how you can unsubscribe from future promotional emails from AgileCraft. You may unsubscribe from our marketing communications by clicking on the "unsubscribe" link located on the bottom of our emails.

With respect to data that we collect when you use and access any AgileCraft products or services, we retain your data (including your Personal Information) according to the timeframes set forth in the relevant agreements with our customers or for as long as needed to provide services to you and your employer. AgileCraft will retain this Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

To exercise any of these rights or if you have any other question, please contact us at support@agilecraft.com. We will respond to your request to change, correct, or delete your information within a reasonable timeframe (usually within sixty (60) days).

Security

AgileCraft implements reasonable security procedures to help protect your Data from security attacks. All interactions with AgileCraft Websites and its hosted Services are protected by SSL-TLS 1.2 as of the date of this publication. Our DNS addresses are protected with DNS-SEC and HTTP Strict Transport Security. However, you understand that use of the Websites and our hosted Services necessarily involves transmission of your Data over networks that are not owned, operated or controlled by us, and we are not responsible for any of your Data lost, altered, intercepted or stored across such networks. We cannot guarantee that our security procedures will be error-free, that transmissions of your Data will always be secure or that unauthorized third parties will never be able to defeat our security measures or those of our third-party service providers. Our breach procedures ensure that we have safeguards and measures in place to identify, assess, investigate and report any personal data breach at the earliest possible time.

Children Under 13

The AgileCraft Products and Services are not directed at children and we do not knowingly collect information from children under 13. If you are aware that a child has provided us with information without parental consent, please contact support@agilecraft.com

Changes to this Privacy Policy

We may update or modify this Privacy Policy from time to time. For meaningful revisions, we will use reasonable efforts to notify you (by, for example, sending an email to the billing or technical contact you designate in the applicable Order or so designated in your registered account with AgileCraft, posting on our blog or in the Product itself). Use of information collected is subject to the Privacy Policy active at that time the information is used.

EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield Statement

AgileCraft participates in, and complies with, the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield. AgileCraft is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. AgileCraft is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and any subsequent transfers to a third party acting as an agent on its behalf. AgileCraft complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, AgileCraft expects to be subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, AgileCraft may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact our U.S.-based third-party dispute resolution provider (free of charge) at https://www.jamsadr.com/eu-us-privacy-shield.

Under certain conditions, more fully described on the Privacy Shield website https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
